Second round of Cultural Heritage co-design under way

Phase 2 of the Aboriginal Cultural Heritage co-design process has commenced for the development of the supporting regulations and guidance which will underpin the Aboriginal Cultural Heritage Act 2021. The Department of Planning, Lands and Heritage (DPLH) has published updated factsheets based on the Phase 1 co-design process and is seeking input from stakeholders as part of the Phase 2 process, as well as undertaking a series of co-design workshops. 

CME encourages members to attend the various workshops being held across WA to provide input into this critical process. Details can be found on the DPLH co-design website, along with copies of the Phase 2 co-design documents. CME will engage in these workshops to provide an industry perspective. 

The development of these supporting documents is critical to the success of the regime, and CME will continue to input into the process of co-design to achieve a practical, workable regulatory framework which functions for all stakeholders.   

DPLH has also called for nominations for the new Aboriginal Cultural Heritage Council. This group will play a critical role in the implementation and operation of the new regime and CME strongly encourages members to consider engaging with relevant skilled and experienced individuals to encourage them to nominate.

Consultation commences on Policy Framework for Diversification Leases  

The Department of Planning Lands and Heritage (DPLH) is currently drafting amendments to the Land Administration Act 1997 (LAA). These amendments will include a new form of non- exclusive leasehold tenure known as a diversification lease. The lease is intended to facilitate a more flexible leasehold tenure, including providing for multiple concurrent land uses. Of particular interest to the resources sector is the potential to use diversification leases to facilitate large scale renewable energy projects. 

DPLH has released an Exposure Draft Policy Framework document, and is currently seeking stakeholder feedback on the use of diversification leases. This Policy Framework will guide the practical implementation by the Department of the Act amendments pending successful passage. 

A detailed summary of the proposed amendments to the LAA is available on the DPLH website, with a draft Bill expected later this year. Members are encouraged to consider providing feedback on the Policy Framework to inform the CME submission to this process.
